U.S. District Judge Beth Labson Freeman in San Jose, California wrote that the plaintiffs “plausibly alleged injury from their exclusion from the market for retailing used goods.” Forcing them to rejoin each time they wanted to sell something, she added, could amount to an illegal use of market power—or maintaining it—to keep them out of e-commerce altogether. The companies also allege that Amazon possessed superior bargaining power over marketplace sellers, in part because third-party vendors were required to pay for all transaction costs.
The suit was brought by four companies—mobile phone cases seller Focalprice Inc., jewelry wholesaler Diamond Fashion USA Inc., children’s clothing retailer Lollytogs Ltd, and footwear seller Mac Owner LLC—that are suing Amazon separately but are being represented by the same legal team. They hope to represent thousands of other merchants who have been shut out of the e-commerce giant’s marketplace over the years, according to one of their lawyers, Dan Ross. If this suit survives scrutiny from a higher court then it could open up a whole new group of sellers that can sue Amazon without having any direct evidence against them other than what happened to other sellers before them.
